Legal Agreement for Pixellark Solutions Services

By using Pixellark Solutions' services, software, or systems, you agree to be bound by these Terms of Service. Please read them carefully before proceeding. If you do not agree, you must discontinue using our services immediately.
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "Customer," or "you") and Pixellark Solutions ("Company," "we," "us," or "our"). By accessing, downloading, installing, or using our software, systems, or services, you acknowledge that you have read, understood, and agree to be bound by these Terms. These Terms apply to all users including businesses, employees, contractors, and agents who access or use our services.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIXELLARK SOLUTIONS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS INTERRUPTION.
Our total liability for any claims related to our services shall not exceed the amount paid by you for the specific service during the twelve (12) months preceding the claim.
We warrant that our software will perform substantially in accordance with its documentation under normal use conditions. This warranty is limited to ninety (90) days from delivery.
EXCEPT AS EXPRESSLY SET FORTH HEREIN, OUR SOFTWARE AND SERVICES ARE PROVIDED "AS IS" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
While our software includes compliance features for various industries (restaurant, pharmacy, retail, etc.), you are ultimately responsible for ensuring your use complies with all applicable laws, regulations, and industry standards in your jurisdiction.
All intellectual property rights in our software, documentation, designs, source code, and related materials remain the exclusive property of Pixellark Solutions. You may not use our trademarks, logos, or other proprietary materials without express written permission.
You may terminate your use of our services at any time by discontinuing use and uninstalling our software. Termination does not relieve you of payment obligations for services already rendered.

These Terms shall be governed by and construed in accordance with the laws of Sri Lanka. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Kurunegala, Sri Lanka.
We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or through our software. Continued use after notification constitutes acceptance of the modified Terms.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Pixellark Solutions shall not be held liable or responsible for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to natural disasters, internet or telecom failures, government actions, labor disputes, or other unforeseen circumstances.
